“Frozen, not deferred”: Anja Vogt and Tamir Livschitz in the Schweizerische Juristen-Zeitung.

Anja Vogt and Tamir Livschitz, Gesperrt, nicht gestundet – Eine fiktive Beschwerde gegen BGer 4A_305/2025 vom 13. März 2026, SJZ 122/2026, p. 725 et seq.

In judgment 4A_305/2025 of 13 March 2026, the Swiss Federal Tribunal refused to enforce an LCIA costs award. It held that the sanctions prohibition on making funds available operates as a “statutory deferral” of the claim. Written as a fictitious appeal against that judgment, the article argues that sanctions restrict the disposal of assets, not the existence or maturity of a claim. Enforcement should have been granted, with any proceeds paid into a frozen account.

Elena Sevila co-chairs CIIAM Working Group on Private Clients and Family Business.

Elena Sevila spoke at the IV Encuentro CIIAM in Madrid at the session of the newly created Working Group on Private Clients and Family Business of the Centro Internacional e Iberoamericano de Arbitraje de Madrid (CIIAM). She co-chairs the group with Javier Robalino Orellana (Robalino).

Elena explained that the group responds to a long-standing gap in the market. Until now, there was no forum that brings together different jurisdictions and perspectives on the particular challenges of private clients and family businesses, a field where legal complexity meets family sensitivities and an increasingly international dimension.

Together with Elena Gutiérrez García de Cortázar (EG Arbitration) and Mariana Pereira (Orienta Legal), the panel discussed families and assets spread across several countries, generational succession and the role of family offices. The speakers made the case for arbitration in such disputes. It offers confidentiality, flexibility, specialist tribunals, swift interim relief and the option of prior mediation, and so protects not only family wealth but also family relationships.

“Until the bitter end? – The duties of banks when sub-custodians refuse to execute instructed transactions” – article by Anja Vogt and Tamir Livschitz published in the Schweizerische Juristen-Zeitung.

Anja Vogt and Tamir Livschitz: Bis zum bitteren Ende? – Die (auftragsrechtlichen) Pflichten von Banken bei verweigerter Ausführung instruierter Transaktionen durch Drittverwahrungsstellen, SJZ 121/2025, p. 1035 et seq.

The article examines the duties of Swiss custodian banks when foreign sub-custodians refuse, on alleged sanctions grounds, to execute client transactions that the bank itself considers permissible. The authors argue that such a refusal does not release the bank from its obligations under mandate law: it must instruct the sub-custodian fully, escalate, and—as a last resort—enforce its rights in court. In their view, the bank can rely on subsequent impossibility (Art. 119 CO) or unreasonableness only in exceptional cases, not on the basis of cost, reputational or business-policy considerations.
